Welcome to HoHoGuess ("Platform", "we", "our", or "us"). By accessing or using the HoHoGuess platform — available at hohoguess.com and its associated mobile experiences — you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms constitute a legally binding agreement between you and HoHoGuess. We reserve the right to update these Terms at any time, and your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
HoHoGuess is a skill-based virtual guessing platform. Users apply knowledge, analysis, and judgment to guess the outcomes of real-world events — including sports, Hong Kong stocks, entertainment, weather, and more. All participation occurs using virtual currencies only. HoHoGuess is not a gambling platform, does not involve real-money wagering, and is not regulated as a gambling operator under applicable gambling and gaming laws and regulations. The Platform is operated as a social entertainment and skill-development game for users in permitted jurisdictions.
HoHoGuess operates two distinct virtual currencies: (1) Peanuts (🥜) — the primary currency used for all guessing activity on the Platform. Peanuts cannot be purchased with real money. They are earned exclusively through daily login rewards, referral bonuses, winnings from guessing, leaderboard prizes, and platform missions. Peanuts have no monetary value and cannot be redeemed or exchanged for real money or goods outside the Platform. A platform fee of 5% of net winnings applies to correct guesses. (2) Popcorn (🍿) — a premium cosmetic currency used solely to purchase items in the Popcorn Shop, such as avatar frames, streak shields, daily boost passes, and season passes. Popcorn may be purchased with real Hong Kong Dollars (HKD) via our third-party payment processor. Popcorn has no monetary value and cannot be redeemed or exchanged for real money, Peanuts, or any other asset.
You must be at least 18 years of age to use HoHoGuess. By creating an account, you represent and warrant that you are 18 years of age or older. The Platform is intended for users in jurisdictions where access to virtual guessing platforms is lawfully permitted. You are solely responsible for determining whether your use of the Platform complies with the laws applicable in your jurisdiction. HoHoGuess reserves the right to terminate accounts of users who are found to be under the age of 18 or who access the Platform from a jurisdiction where such use is prohibited.
By using HoHoGuess, you agree not to: (a) use the Platform for any unlawful purpose or in violation of any applicable laws or regulations; (b) attempt to manipulate guessing markets through collusion, bot activity, or coordinated abuse; (c) create multiple accounts to exploit referral bonuses or platform rewards; (d) reverse-engineer, scrape, or otherwise attempt to extract proprietary systems or data from the Platform; (e) impersonate another user, HoHoGuess staff, or any other person or entity; (f) post content that is defamatory, threatening, harassing, obscene, or otherwise objectionable; (g) interfere with the security, integrity, or availability of the Platform or its infrastructure. Violation of these rules may result in account suspension, permanent ban, and forfeiture of virtual currency balances without compensation.
All content on HoHoGuess — including but not limited to the platform name, logo, branding, interface design, guessing market structures, gamification systems, and written content — is owned by or licensed to HoHoGuess and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Platform solely for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.
HoHoGuess is committed to protecting your personal data in accordance with applicable data protection laws and standards. We collect and process personal data only as necessary to operate the Platform, provide services, and comply with legal obligations. Please review our Privacy Policy for full details on what data we collect, how it is used, and your rights as a data subject. By using the Platform, you consent to the collection and use of your personal data as described in our Privacy Policy.
HoHoGuess is provided on an "as is" and "as available" basis without any warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. All virtual currencies and in-platform items are provided for entertainment purposes only and have no real-world monetary value. To the fullest extent permitted by applicable law, HoHoGuess and its affiliates, directors, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if advised of the possibility of such damages. Our total aggregate liability to you for any claim arising under these Terms shall not exceed HKD 100.
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you via the Platform or by email. Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of those changes. We encourage you to review these Terms periodically.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Platform's parent entity is incorporated, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
